UPDATE Santa Clara County Return of Property in Latest Case (Liam)

Hello All:

Great news to update regarding the most recent case in Santa Clara County.

It appears that after much wrangling and nashing of teeth with Sgt. Greg of San Jose PD, that Liam will be getting his property back.

Liam and I have been corresponding via email and I am pleased to report that after much run around and BS from Sgt. Greg, Narcotics, Liam will (or should be) receiving his plants back by Wednesday (Feb. 7) next week.

After several calls that went unreturned by Sgt. Greg, I was able to personally speak to him yesterday afternoon just before 5pm. In my previous messages I explained to Sgt. Greg who I was and what I was calling him for. I asked Sgt. Greg to go back through their Narcotics files and speak with Sgt. Bowen about me and my prior cases (Sgt. Bowen used my information to train his officers with my permission) and look at their own evidence logs to see that it is not illegal or against federal law to return property. (I was even able to get his cell phone number one day--chose not to use it--but will keep it on file).

Sgt. Greg told me yesterday that they dried 28 grams for evidence but the rest of Liam's stuff was "goop". He assured me that Liam would be getting all his property back even though he said he was only going to return the processed MMJ. I explained to Sgt. Greg that although he may think the rest of the stuff in the cardboard box is "goop" and unusable--Liam wants it all back. I further explained that in some cases the MMJ can be saved by rewashing and redrying it.

I thanked him for his assistance in the return and sympathized with the plight of law enforcement regarding the ambiguities in the law and explained to him that I intend to ramp up efforts to clarify that issue at a State level.

So, we hold our breath once again....waiting....to see the end result.

Liam will post the outcome.

UPDATE Santa Clara County Case

The SVCPU is pleased to report, in the most recent case we are aware of, Liam Blaney, Liam has FINALLY received his medical marijuana back.
It has taken him almost a month of wrangling and much hand wringing but he did get most of his MMJ back. After dealing with the poor storage issues of SJPD, he was able to recoup appoximately a quarter pound of the four plants they took initially. He is still dealing with return of the security camera and a few other small items but again.............
JUSTICE IS SERVED by standing up for your rights and the rights of all patients.
